1. About These Terms

These Terms of Service ("Terms") govern your use of the busi.au website builder platform operated at busi.au ("we", "us", "our"). By using our service, you agree to these Terms. If you do not agree, please do not use our service.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date.

2. Service Description

busi.au is a website builder service that generates professional static websites for small businesses. We provide:

  • An intake form to collect your business information
  • Automated website generation from your submitted data
  • Website hosting on a subdomain of busi.au or your own custom domain
  • A customer dashboard to manage and edit your site

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our service. By creating an account, you represent that you meet these requirements.

4. Your Account

When you submit the intake form, we create an account for you using the email address you provide. You are responsible for:

  • Keeping your login credentials secure
  • All activity that occurs under your account
  • Ensuring your contact information is accurate and up to date

5. Subscriptions and Payment

Our service is offered on a subscription basis. By subscribing to a paid plan, you agree to pay the fees associated with your chosen plan. Payments are processed securely via Stripe.

  • Subscriptions renew automatically at the end of each billing period (monthly or yearly)
  • You can cancel your subscription at any time from your dashboard or by contacting us
  • Upon cancellation, your site will remain active until the end of the current billing period, after which it will be suspended
  • All prices are in Australian Dollars (AUD) and include GST where applicable

6. Your Content

You retain ownership of all content you provide to us (business information, images, text). By submitting content, you grant us a licence to use, display, and host that content solely for the purpose of providing the service to you.

You are responsible for ensuring that your content:

  • Does not infringe any third-party intellectual property rights
  • Does not contain unlawful, defamatory, or misleading material
  • Complies with all applicable Australian laws and regulations
  • Does not contain malicious code or harmful content

7. Acceptable Use

You must not use our service to:

  • Create websites promoting illegal activities or products
  • Distribute spam, malware, or phishing content
  • Impersonate another person or business
  • Interfere with or disrupt the service or its infrastructure
  • Attempt to gain unauthorised access to our systems

We reserve the right to suspend or terminate your account if you breach these terms.

8. Intellectual Property

The busi.au platform, including its design, code, templates, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or redistribute any part of our platform without our written consent.

9. Service Availability

We aim to keep the service available at all times but do not guarantee uninterrupted access. We may occasionally need to perform maintenance or updates that temporarily affect availability. We will endeavour to provide notice of planned downtime where possible.

10. Limitation of Liability

To the maximum extent permitted by law, including the Australian Consumer Law:

  • Our total liability to you for any claim arising from the service is limited to the amount you have paid us in the 12 months preceding the claim
  • We are not liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities
  • We are not liable for any loss arising from circumstances beyond our reasonable control

Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded or limited by law.

11. Termination

You may close your account at any time by contacting us at hello@busi.au. We may suspend or terminate your account if you breach these Terms, with or without notice depending on the severity of the breach.

12. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be subject to the jurisdiction of the courts of Australia.
